Morocco: The Absence of a Legal Text that Regulates the Right to Strike

The Administrative Court of Appeal in Rabat upheld the verdict of the Court of First Instance to annul the decision of pay deduction in the Moroccan Pension Fund. The decision was issued by the administration against 270 employees who organized two protests inside the workplace for a period of two hours each. The administration considered them absent from work for half a day.

 

 The appellate judgment considered the decision as illegitimate and a violation of the law and the formal procedures required for salary deduction due to absence from work without legal justifications.

 

In the absence of a legal text regulating the right to strike in its various forms, the administration does not have the right to use (and abuse) the ‘wage for work’ rule for salary deduction.
