Jordan: Details of the amended Labor Code

The amended Labor Code has strengthened the ministry's programs in the employment sector and has returned to the issue of the 'Outsource Company' in order to regulate and encourage the employment of Jordanians, instead of foreigners , within these companies; this is done through the commitment of the mediation company to the beneficiary of the service to perform part of their work on their behalf and to contract with the workers so that they are affiliated to the mediation company and not to the beneficiary , and all of this is linked to agreements that guarantee the level of service required.

The bill has given the minister more flexibility in terms of the length of the work permit, which will become two years for foreigners in certain sectors including the agriculture sector. In addition, the new text has increased the sanctions against employers who illegally recruit foreign workers; these employers will have to pay the equivalent of the costs of two work permits (if the permit is 500 dinars) and the fees of four permits in the event of a repeat offense.

In this context, the press agency 'Petra' indicated that if a worker works without a work permit or in a sector for which he has obtained his permit, the Minister can decide to expel him and he will not be able to work again in Jordan only after five years from the date of expulsion.

The amended Labor Code also allowed workers to leave work without any warning, while preserving all their rights, in the event of proven sexual harassment by the employer or the person representing him.

The amendments also dealt with illegal and unauthorized employment which harms the interests of the workers and, in this context, increased the sanctions (from 3,000 to 5,000 dinars with a possible prison sentence).
