Iraq: New draft law against domestic violence

The presidency of the republic announced, early this week, that it has sent the bill against domestic violence to parliament. In this context, the online newspaper 'Alsumaria News' indicated that the draft law in question, sent to Parliament on 15/09/2019, aims to protect the family and, above all, women and girls, all forms of violence based on social gender by punishing the aggressors and by compensating and protecting the victims.

The Presidency explained that this new text provides for the formation of a high committee by the Ministerial Council (High Committee for Combating Domestic Violence) chaired by the Minister of Labor and Social Affairs. The Ministerial Council will also form a Department of Family Protection within the Ministry of the Interior to implement the new law to be chaired by a Director-General with a minimum of five years' experience in social affairs management. . In addition, a specialized court will be established by the Supreme Judicial Council to manage family affairs.

The online newspaper 'Alsumaria News' reported that the new text obliges the Ministry of Labor and Social Affairs to open secure centers to welcome, protect and reintegrate victims of domestic violence in all governorates of the country. Specialized non-governmental organizations may also open similar centers with the authorization of the parent ministry.

The new bill also gives the court the possibility of issuing an emergency protection decision and allowing reconciliation between the victim and the aggressor at the expense of the case.
