What do you know about the articles of association of a trade union organization in Egypt?

Amendments are recently made to Trade Union Organization Law (No. 213 of 2017), which is specifically related to the way and mechanism of setting up a trade union, of all forms, either trade union committees, general trade unions, or labor federations.

Chapter II of such law articulated the way of setting up a trade union organization along with its objective. Article 10 stipulated: "setting up labor union organizations shall be for all, and it shall be provided the legal personality as of submitting the required documents to the official authority, and it shall exercise its activity as of this date, and each organization shall have articles of association that shall be published in the Official Egyptian Gazette".

The law stipulated terms and conditions for setting up trade union organizations. As for the labor union committees, Article 11 stipulates: "workers within the organization shall have the right to set up a labor union committee with a membership of at least 50 workers. As for the organization that fails to meet the quorum, the organizations that have less than 50 workers, and the workers having profession or craft, all have the right to set up a professional labor union committee on the city or province level, as the case may require, whose number of workers shall not be less than 50, in collaborating with others of the same professional, occupational or industrial group that are related to each other or sharing the same production, provided that such professions that are supplementary to some industries are within such industries subject to the international standards applied in such regard".

As for the general labor unions, Articles 12 stipulated: "In setting up general labor unions, it shall be composed of at least 10 trade union committees with a membership of at least 15 thousand workers".

Regarding the labor federation, Article 12 indicated "it shall be composed of at least 7 general labor unions with a membership of at least 15 thousand workers".

On taking the constituent assembly of the under-establishment trade union organization the responsibility, Article 18 defined that it shall submit 3 copies of founding documents to the competent authority, which are a detailed statement mentioning the names of who set up such trade union organizations, articles of association, a minute of board of directors election, in addition to detailed statements listing the names of board of directors and office body

In addition, for setting up a general trade union and labor federation, it shall require submitting a statement of number of labor union committees affiliated to general trade union, its names, and minutes of formation, or number of general trade unions subscribed to the labor federation, its names, its minutes of formation, and a statement of workers number that are involved in the membership of trade union organization, as the case may require.

The competent authority shall issue a minute regarding submitting the foundation documents, and it shall provide the trade union organization representative a certified

photocopy of such documents and official letters for the bank, set by the trade union organization for opening an account, and the Civil Status Authority for authorizing the trade union organization stamps, the General Organization for Government Printing offices for publishing the articles of association of the trade union organization, and the application minutes in the Official Egyptian Gazette.
