Kuwait: A proposal in the parliament to pay the employees going on early retirement a full pension

A number of MPs in the Kuwaiti Parliament proposed a law by adding Article 32 bis to the Decree-Law No. 15 of 1979 regarding the Civil Service, which guarantees a full pension to employees who choses early retirement.

The proposal stipulates:

(Article 32 bis): "An employee may be referred to retirement if he / she deserves a pension if his / her service ends by resigning at the time of such assignment".

The referral to retirement decision is taken by the Minister, except for the occupants of leading positions, for whom the decision is taken by the Civil Service Council following the proposal of the Minister, where these employees’ financial status has to be settled as if they have completed their service at the age of sixty-five.

The explanatory memorandum stated that the state needs to "renew the workers in its administrative and functional apparatus and open an opportunity for the recruitment of Kuwaiti youth seeking employment." Therefore, the state recently resorted to referring many employees to retirement before reaching the legal age of referral provided for in the Civil Service Law No. 15 of 1979 (65 years), based on Article 76 of the Civil Service Decree issued on 4/4/1979.”

The memorandum emphasized that the Kuwaiti employees referred to retirement should not be harmed in accordance with this Article as a result of the reduction in their pensions, noting that if they are referred to the pension before the legal age of 65 years old, this amendment will ensure the provision of job security for state employees to maintain their pension and ensure that the assigned employee is not harmed by reducing his/her pension to protect the Kuwaiti low-income employees to guarantee them a decent life after retirement.
