The General Confederation of Moroccan Enterprises (CGEM) has called for a reform of the labour law in light of the socio-economic changes. This proposal has been denounced by trade unions, which are firmly opposed to the concept of “labour flexibility,” claiming that it is a violation of the workers’ rights.
CGEM presented a “white paper” that includes many proposals including flexibility, new working methods, professional mobility, labour law reforms, and social mediation. The document contains concrete measures for the implementation of the New Development Model (NMD) by employers, affecting the entire private sector.
The CGEM put forward ten priorities aiming at “modernising the labour law in order to bring it into line with socio-economic changes.”
NMD highlights the gap between labour legislation and the current socio-economic changes, claiming that “the current legislation is incomplete and leads to stagnation that does not serve the interests of workers.”
According to the CGEM, the current law does not consider new working methods. Hence, social dialogue is not successful.
Moroccan employers stated that the current laws “hamper the proper functioning of work” and recalled that the essential role of these laws is to increase productivity and improve the competitiveness of the private sector.
The CGEM advocates above all labour flexibility, considering it to be a direct consequence of the current dynamics of the global economy. According to the same source, this flexibility is effective against unemployment by offering companies a better balance between supply and demand.
Within the framework of the tripartite dialogue, the organisation proposed various amendments to the labour law which aim to define a general framework in light of the vicissitudes of the world economy, in sync with the Moroccan context and social protection in the country.
In addition to labour flexibility, these proposals address on other areas such as disciplinary measures, social mediation, occupational medicine, or the regulation of the use of part-time work.
