The General Federation of Palestinian Trade Unions issued a call about the failure of some private sector institutions to comply with the Palestinian Labor Law, especially Article (38), and their lack of commitment to the provisions of the agreement signed between the parties to production at the headquarters of the Ministry of Labor in Ramallah on March 16, which included a commitment by representatives of the private sector to pay workers’ wages for the months of March and April 2020, 50% of the wage and at least 1000 NIS, with the remainder to be paid at the end of the crisis.
The union highlighted that a part of the private sector has become reluctant to tolerate all of their workers’ rigghts, and major establishments and companies have signed workers’ collective resignations, leaving them with no pay and not giving them the salaries of their worked days.
The union indicated that this constitutes a brutal and direct violation of the labor law and a violation of the aforementioned agreement, after the Prime Minister declared under the Emergency Law the restriction of movement between governorates and control of movement within the same governorate in order to preserve the health and safety of citizens.
The union reminded that the Palestinian labor law was found to protect workers, including ensuring their right to leave, and their right to spend their salaries in no more than two months in light of emergencies and similar cases, because some of the private sector institutions are not entitled to terminate workers’ labor contracts, indicating that such act involves a grave breach of the laws and regulations in force in Palestine and the decree of His Excellency President Abu Mazen who declared a state of emergency, knowing that everything mentioned is contrary to all laws and humanity, knowing that male and female workers are the most committed to continuing work.
The union also called on the workers not to sign any type of leave without salary or individual or collective resignations, or any clearances with employers, stressing that they should go to their respective unions to inform them of this violation, and these issues will be followed up by the committees formed in all governorates, even if it requires the filing of lawsuits against those who do so from the private sector and full financial coverage by the union, declaring that the union will expose all violators of the agreement signed by the three parties, and will call for a comprehensive strike against any establishment taking any action against the workers.
