The General Commission of Adult Education in Egypt Notes a Crude Intervention in Union Affairs after the Dismissal of the Union's President

After his dismissal of the president of the Independent Syndicate Committee of the staff operating at the General Commission of Adult Education, the head of the agency sent a letter to the union’s vice president notifying him of the necessity to dismiss the union’s president from his position as head of the trade union committee, , something they considered a crude intervention in trade union affairs.

The head of the agency relied on wrong interpretations of articles of the Syndical Organizations Law No. 213 of 2017, and intentionally ignored many other articles of the law that prohibit the employer from interfering in union affairs which affirms that the general assembly is the only authority that manages union affairs.

The Trade Union and Workers Services House confirmed that the head of the agency committed such acts to separate the union’s president and to abuse the union’s treasurer in an explicit violation of some articles of the Trade Union Organizations Law No. 213 of 2017.

Article 52, precisely, states that: “A member of the board of the trade union organization may not be suspended from work at the affiliated facility whether as a precautionary or disciplinary measure, or the imposition of a penalty of dismissal against [the individual] except on the basis of a decision or ruling issued by a competent court.”

The article also states that “It is also not permissible to delegate [the individual] for a period of more than two weeks, or to have him/her transfer from the establishment inside or outside the city in which his/her workplace is located during the period of the union session except after a written approval was issued in this regard.

The House clarified that the provisions of the previous two paragraphs apply to candidates for membership of the Board of Directors of the trade union organization during the candidacy period for this organization from the date of the opening of the candidacy until the date of announcing the results.

It also applies to the worker who performs the preparatory work for the establishment and formation of a trade union organization with a maximum period of one month starting from the date on which the administrative authority was notified according to the provisions of this law.
