New Decisions Regarding Foreign Workers in Jordan

The Jordanian Labor Observatory reported that the Minister of Labor Nidal Al-Batayneh decided to allow employers to renew the work permits for non-Jordanian workers with the same employer (Those who are still working for the same employer).

That should be within the permitted professions (the ones other than closed and restricted professions and specialized skills professions) without being restricted in the specified rates.

The batch of taken decisions would start being valid as of April 4, 2020.

Al-Batayneh also decided to hire non-Jordanian workers (for the first time) that are present on the Kingdom’s territories before February 1, 2020 in permissible professions without being bound to the specified percentages, until April 30, 2020.

Al-Batayneh explained that these procedures do not include non-Jordanian workers who have obtained a final departure or seal of no-objection to the payment of social security benefits after September 21, 2019, with the exception of non-Jordanian workers of the following categories:

1 / Husbands or wives of Jordanian citizens.

2 / Gaza Strip individuals who hold a white card issued by the Civil Status and Passports Department, in effect.

3 / Valid temporary Jordanian passport holders.

4 / Those who obtain a no-objection stamp for the disbursement of social security benefits concerning old-age salaries.

The Minister of Labor added that renewing work permits for non-Jordanian workers without adhering to the percentages prescribed for all economic sectors according to this decision would be the last of its kind and for a specific period elapsing on April 30, 2020.

AL-Batayneh also mentioned that employers hiring foreign workers should implement the necessary training programs or benefit the Ministry’s programs, such as the “Watan Service” Program or the training programs implemented by the Vocational Training Corporation or the National Employment and Training Company and other training providers.

The Ministry called on all labor directorates to guide employers in the implementation of these training programs to ensure the placement of Jordanian workers instead of foreign workers during this last year.

The Minister of Labor confirmed that according to the ministry’s plan, it will abstain from foreign workers recruitment, except for domestic workers.

He also insisted that it is compulsory for employers to find appropriate alternatives, whether it is Jordanian workers or foreign workers that are present in the labor market.

The Ministry called on the establishments to take advantage of this decision until April 30, 2020, noting that after the set date, all economic establishments and sectors will have to adhere to the ratios enforced by the Ministry in this regard.
