Jordan: The Office of Workers for Studies and Research calls for the revision of the Labor Code

A report published by the Office of Workers for Studies and Research explained that the amendments to the Labor Code last May need to be revised, especially in terms of the new definitions introduced in the law, as in the definition flexible work, partial work and wage discrimination.

The amendments in question brought new powers to the Minister of Labor to designate work attachés abroad, except that the report explained that, logically, this prerogative is the responsibility of the Ministerial Council, in accordance with the civil service regime.

In addition, the amendments dedicated part of the income from work permits to the recruitment of experts and skills for the benefit of the Ministry of Labor, which can cause, according to the report of the Office of the Workers for Studies and Research, questionable recruitments and mismanagement of public money.

The same report pointed out that the amendments did not provide any legal treatment for daily workers (free work permit) while the Labor Code does not provide any article dedicated to this category of workers. The report explained that the law stipulates the existence of a contract between the employer and the employee, which is not the case for the free labor permit that does not require any official document between the two parties. In the absence of an official contract, the Office report called for the establishment of legal texts regulating and fixing the contractual quality of the worker. And to add that this kind of work permit must absolutely provide the worker with social security cover and determine the party responsible in the event of an accident at work.

The Office of Workers for Studies and Research has also indicated that the amendments exempt the employer from sanctions for the illegal recruitment of foreign workers if the employer comes to the Ministry to denounce the escape of the worker in question; for the Board, this exemption provides a legal loophole that will lead to an amplification of the problem of foreign labor recruitment, especially since alerts on the flight of foreign workers are often linked to brokerage cases. or exploitation which is detrimental to Jordan's reputation.
