Fines and sanctions for those who do not comply with the law on domestic work in Morocco

According to Hespress website, Moroccan families who do not comply with the law by not providing social security for domestic workers, will be sanctioned as stipulated by the Moroccan law on domestic work number 19.12.

The law listed many sanctions and will be implemented starting from the middle of next year.

Employers who don’t sign a contract in three copies or neglect or refuse to provide the work inspection with a copy of the contract will be sanctioned by fines between 3000 and 5000 Dirhams (300 and 500$).

The employer shall also provide the Social Security with a copy of the contract within a month from the date the contract is signed.

The employer is in charge of all the social security and health insurance fees, which amount to 25,66% of the salary, which can’t be less than 1542 Dirhams and has to be raised by 5% in July 2019 and another 5% in July 2020.

The law number 19.12 imposed a fine between 500 and 1200 Dirhams (50 and 125$) on employers who don’t give the worker a weekly day of rest.

Working hours shall not exceed 48 hours per week, with a weekly rest of at least 24 hours and 40 hours a week for workers aged between 16 and 18 years old.

The law protects any domestic worker, whether Moroccan or not, working in cleaning houses, looking after children or any old or disabled person, driving, gardening or guarding houses.
