The Presidency of the Council of Ministers announced the possibility of taking an unpaid leave without a maximum limit, provided the payment of social insurance. The leave coincides with the Civil Service Law and its executive regulations, after a complaint launched by some workers abroad and inside, as they faced restrictions in obtaining an unpaid leave, despite that being allowed by law.
According to local media, the required situations to have an unpaid leave include, traveling (external employment), secondment, and taking care of the family.
The new law is summarized in the release of special unpaid leaves and secondment periods, following the reasons expressed by the employee, who is subject to the provisions of the civil service law and it is evaluated by the competent authority, in accordance to the law. The secondment or annual leave is renewed at the request of the employee ,before the end of his/her secondment period, his/her unpaid 30-days leave, without requiring his/her personal presence, as he/she may be represented by one of his/her relatives, up to the second degree, or others with a special attorney.
The competent authority shall approve the request within 15 days from the date of its submission unless the employee is subject to the disciplinary proceedings or financial obligations submitted by his/her employer, unless he/she has paid them.
On the other hand, the National Authority for Social Insurance’s insurance premiums should be paid for the period prior to the leave, as delay penalties will be imposed in case of delay in payment.
Bodies that are not covered by the law: the judicial bodies, faculty members, members of the diplomatic and consular sectors, members of the Civil Police Commission, civil workers, officers and members of the armed forces, and the employees of the Presidency of the Republic, with the possibility of excluding others by the Council of Ministers.
Some governors have taken a decision not to renew the leaving for contractors and secondments abroad, on the grounds that they occupy jobs they are not actually fulfilling.
