The Parliament's Services Committee unanimously approved the Decree Law No. 59 of 2018, to amend certain provisions of the Labour Law in the private sector issued by Law No. 36 of 2012, which aims to regulate the mechanism for paying the workers' wages.
This mechanism includes procedures and controls that oblige the public and private entities to disclose to the concerned authorities, information concerning the payment of wages and the prohibition of discrimination among workers, who are subject to the labour law in the private sector, because of their gender, origin, language, religion or beliefs, and to impose a penalty between 200 and 500 dinars for those who violate the law.
The law also criminalizes the sexual harassment of workers by imposing a penalty of imprisonment for a period not exceeding one year or a fine not exceeding 100 dinars for every worker, who has sexually harassed one of his colleagues. This penalty is aggravated, if the crime is committed by the employer or one of his representatives.
In this context, the Bahrain Chamber of Commerce and Industry (BCCI) approved on the decree, according to a law that is in line with the recommendations of the ILO's international standards and human rights principles. It also pointed out that the transfer of the worker's monthly wage to his bank account requires the worker's consent. In fact, it proposed to postpone the implementation of this system to small, medium and micro enterprises for at least one year, in order to know the duration of the ability of these institutions to implement this system and its impact on them. Moreover, it highlighted the need to agree with the Central Bank of Bahrain and all the banks in the Kingdom with a minimum wage for low-wage workers for at least 5 years with no unreasonable fees or hidden charges.
