UAE: Law experts propose fines to deter the false accusations lodged against their employees

The UAE legal experts proposed fines for the establishments, where false accusations were filed against the employees, with a fine of about 50 000 000 dirhams. This fine will be be paid to the worker, in case he is innocent. The UAE legislator is expected to increase the protection of the worker in the labor rela-tionship, as his coverage is similar to the special judicial immunity, especially in cases where they may file a labor complaint before the competent authorities.

The Emirati “Al-Bayan” website declared that in some cases the employees of the establishments were accused of stealing. In fact, these cases were filed after the employee’s filing of a case, in which he claims his delayed dues or salaries.

According to observers, the false accusations are very dangerous for the two parties. They asked for be-ing firm in facing these false allegations and to verify their validity, as it is a crime aimed at harming oth-ers, pointing out that anyone who filed a malicious complaint against a person and was sent to prison should pay the worker's salary ,during the period of his imprisonment, even if the complainer is not the employer, according to the provisions of the Federal Law No. 10 of 2017 concerning the services’ work-ers, whose executive regulations are expected to be issued soon.

It is noteworthy that the employer has the right to suspend or freeze the payment of the employees’ salaries if they commit a crime or an offense that necessitated his provisional detention, during the pe-riod of his detention, and if their innocence is proved, their dues will be paid retroactively.
