The Ministry of Justice announced that the total number of the requests submitted to the courts and the enforcement services regarding the execution of a judgment for a financial amount for a work contract amounted to 68 requests valued at 28 million riyals, last month without mentioning the companies’ names that were obliged to pay the dues of the affected workers.
The Saudi authorities seek to launch labor courts in the kingdom and to transfer the jurisdiction of the workers' cases to the public judiciary instead of the labor dispute settlement bodies. This came after the signing of the Ministries of Justice, Labor and Social Development of a memorandum of cooperation on the transfer of jurisdiction of labor cases from the labor dispute settlement bodies to the public courts. The two ministries stressed the need for the continuous coordination between them, in order to to ensure the success of the labor courts and overcome all the difficulties.
In accordance with article 34 of the “Sharia” Proceedings Law, the labor courts seek to hear the cases relating to the labor system, such as disputes concerning labor contracts, wages, rights, work injuries and their compensation, as well as, the disputes concerning the employers’ imposition of disciplinary sanctions on workers or relating to the exemption request from them, in addition to the cases raised against the penalties stipulated in the Labor Law, and the disputes resulting from the implementation of the labor system and the social insurance system.
It is noteworthy that the Saudi Arabia has about 11 million foreign workers, most of who work in the private sector.
