The Algerian National Agency for Employment announced new conditions the subcontracting system, in the country, in various sectors.
It highlighted that the executive decree No. 18-193 of 22 July 2018, amended and supplemented by the executive order No. 07-123 of 24 April 2007, which regulates the conditions of granting accreditation to private bodies for the appointment and dismissal of workers, identified the standard workload book on the public service and the recruitments of workers.
Article 8 of the decree issued in the latest edition of the official journal states that the applicant must deposit the administrative and technical files together with the subscription in the workload book, at the competent regional directorate of the province, which ensures its compliance through the workload book’s conditions and sends it to the minister in charge of employment, who shall notify the Joint Ministerial Committee for Accreditation in order to express his opinion.
The accreditation of the special employment commission shall be granted by a decision of the Minister of Employment for a renewable period of five years. The contract may be withdrawn in case of breach of obligations resulting from the legislative and regulatory provisions, especially the non-use of favoritism, during the three months following the issuance of the accreditation.
The workers of the Ministry of Labour and Employment responsible for monitoring and supervision have to register the visits and inspections in a numbered and indexed register. In addition they have to prepare the report of the visits containing observations, suggestions and recommendations, then, they have to send it within eight days to the Minister in charge of employment, in addition to sending a copy to the State Labour Inspectorate and the Employment Directorate of the regionally competent governorate.
In case of the violation of the legislation and regulation passed by the concerned private bodies for employment, during the visit of the observer, the concerned private bodies shall be subject to the temporary suspension of the activity for three months, as punishment on the basis of the report of the employment regional director, following the governor’s decision who have to report it to the Ministry of Employment.
