The Court of First Instance in Rabat has recently ruled that the dismissal decision taken by the management of the “AXA SERVICES MAROC“ in “Sala Al Jadida” is unlawful, and granted the compensation for the complainant, who is the representative of the workers.
The trade union sources pointed out that the court’s decision left a state of relief among the workers and trade union organizations in the city, which acquitted the workers and their representatives. It will be a good lesson in the future for any company that risks and break the law and takes the decision of collective expulsion without reasonable legal grounds, without considering all the procedures in force, as defined in the Moroccan Labor Code.
One of the provisions of the Labor Code that was violated by the French company is an article that stresses the need to notify the workers of the expulsion decision, which was not respected in the case of the worker's representative, “Jawad Lakhal”, who resorted to the judiciary and had been acquitted.
The sources also confirmed that the decision of the collective expulsion of the call center "AXA Services Morocco" workers, was taken for retaliation purposes by the management of the institution, after the formation of a trade union office.
The affected employees believe that this decision is arbitrary by any standards, and that the company jumped into taking the decisions of the dismissal, since it was based only on preliminary provisions, that have not yet been considered by the appeal, pointing out that the French director, "De Latai" had to respect the Moroccan law, and wait for the issuance of the final judgments. However, he violated all this, and took decisions on the layoff of workers, with non-reasonable justifications, as long as, the judgments are not final, and as each accused is innocent until proved guilty, according to both the French and Moroccan laws.
The victims declared their recourse to justice, pointing out that they will take all the possible steps to face the director and protect their rights and to even resort and contact the French president, if necessary.
It is expected that the French government officials will also be informed of abuses taking place at the center, in terms of working hours, low wages, ill-treatment.
