Jordan: still unable to achieve international standards against human trafficking

“Alghad” website stated that the “Tamkeen” Center issued a statement on the occasion of the World Day against Human Trafficking, in which it affirmed that despite the implementation of the international covenants on the criminalization of human trafficking and the issuance of the necessary legislations, the practices and legislative texts are still far from achieving the international standards.

It also pointed out that the adoption of the definition of crime came within the protocol to prevent and suppress human trafficking, especially with women and children, as the generality of the terms under "trafficking" and their lack of adaptation in the Jordanian reality make the law difficult to implement.

Moreover, it pointed out that there was a conflict of laws and gaps within some of them, which made it difficult to identify trafficking victims from migrant workers and made them vulnerable, so that they were more likely to be exploited by employers.

It is noteworthy that the US Department of State has classified Jordan as the world's second highest level of human trafficking this year, considering it a destination country and transit country for adults and children subjected to forced labor, and a lesser extent in the exploitation of sex.

The center called for the reduction of forced labor, the enactment of appropriate legislation and the adoption of appropriate administrative measures to eliminate this practice and punish its perpetrators, by abolishing their security circular and the sponsorship system which entrenched forced labor to help its existence and violate the fundamental rights of a worker who has become a security suspect, following a quarrel with his employer.

The center also called for finding the legislations that would give the worker / victim the right to a legitimate residence permit or a work permit during the consideration of their case, because the current legislation in force do not allow the victim to travel at any time.

“Tamkeen” emphasized the importance of public prosecutors specializing in human trafficking cases, contributing to the speed of litigation and the adaptation of human trafficking cases rather than cases of labor violations.
