UAE: To what extent is the imposition of sanctions serious about the enterprises’ disregard on the salaries of their workers?

The ministry of Human Resources and Emiratisation kept the confidentiality of workers 'and employees' complaints regarding the delay in paying their wages by their establishments, stressing that the decision to protect wages imposes severe penalties against the negligent enterprises of their workers’ salaries. It starts with a warning, then drops its category to category III, and ends by informing the judicial authorities.

The Ministry confirmed that the Labour Relations Act took into account the rules of discipline and granted the employers the right to set up sanction regulations for employees, including violations and penalties that may be imposed on the violators, pointing out that the model regulation listed 10 violations about work schedules.

It said that in case that the ministry ascertained that the end of the employment relationship has been illegal by the worker or the employer and in case it has not been able to settle the dispute and return the worker to his work, it will refer the dispute to the competent court after five working days to notify the parties of the dispute to settle it peacefully, and that the court should oblige the party which proves its arbitrariness to the compensation it estimates.

These new measures come amidst the criticisms of the UAE authorities' commitment to follow up the owners of establishments that do not respect these decisions.
