Jordan: Parliament passes a law that allows rapists to avoid punishment if they marry their underage victims

Jordan – The Legal Committee of the House of Representatives decided to limit the suspension of legal prosecution, in relation to Article 308 of the Penal Code, with only three cases, which were mentioned in articles 298,304,294. The amendments, which included a full chapter of the Penal Code, decided to double the number of years of which a wife must remain with her rapist husband, so he would not be prosecuted if an offense was committed in relation to article 308 of the Penal Code. The amended text reads as follows: If a valid marriage takes place between the perpetrators of an offense set out in articles 294/1, 298/1 and 304/1 and the victim, prosecution is suspended, and if the verdict was issued in the case, the punishment imposed on the convicted person is suspended.” Article (294/1) after the amendment stated that: “if a person rape a female (other than his wife) who completed fifteenth and did not complete eighteen years is punished by hard labour for a period of not less than seven years. Article (298/1) stipulates that: Any person who raped or threatens to rape a child – male or female – who has completed the age of 15 years and has not yet completed 18 years or forced them to commit an act of indecent assault shall be punished by temporary hard labour for a period not exceeding ten years. Article 304 (1) stipulates that: Anyone who deceives a virgin over the age of eighteen years by promise of marriage, and had her lost her virginity or got her pregnant shall be punished – if his action does not require a heavier penalty – to imprisonment from six months to three years.
