Palestine –lawyer Nael Alhouh criticized the decision of Labour Minister to freeze the Palestinian Trade unions funds, and considered it freedom violation, and intervention in the powers of the union that do not follow the labour ministry in any legal format.
He stressed that the government and the Ministry of Labour need to respect the rule of law. Alhouh said the minister of labour should have headed to the court if he wanted a decision against the union According to the Palestinian labour law, the ministry does not have authority over the trade union, only the Office of Financial and Administrative has the right to monitor the unions financial and administrative procedures, and some things are subject to the powers of the Interior Ministry based on agreements signed with the Arab Labour Organization.
Some might say that a law is needed to organize labour union, but it is not the problem of the union that the Authority has not yet made a law to regulate the work of trade union in Palestine. He added
Alhouh stressed that no license or work permit for any of the trade unions has been issued up to date. He also demanded the minister to disclose the defect, and said it cant be circulated to all trade unions.
He said that curbing the freedom of the trade union, violates the government policies, especially after the protests against the Social Security Act.
Alhouh said that this decision has many negative consequences such as cancellation of some international grants and projects; he also considered it as call to donors to halt its projects and activities in Palestine.
Alhouh urged the union to claim its rights and refuse the ministrys decision by seeking The High Court of Justice, he also demanded the prime minister for urgent intervention to straighten this decision.
